1. Acceptance of Terms

By downloading, installing, accessing, or using Kinesis: Social Fitness App ("Kinesis", "the App", "we", "our", or "us"), developed by Ivan Sentemon, you ("you", "your", "User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Ivan Sentemon. Please read them carefully.

2. Eligibility

You must be at least 16 years of age to create an account and use Kinesis. By using the App, you represent and warrant that:

• You are at least 16 years old.
• You have the legal capacity to enter into these Terms.
• Your use of the App does not violate any applicable law or regulation.

If we discover or reasonably believe that a User is under 16, we will promptly terminate that account and delete associated personal data.

3. Account Registration and Security

3.1 Account Creation

To use Kinesis, you must create an account by providing accurate and complete information, including your name, username, email address, and password. You may also register using Google Sign-In.

3.2 Account Responsibility

You are solely responsible for:

• Maintaining the confidentiality of your login credentials.
• All activities that occur under your account.
• Notifying us immediately at kinesis.fitness.app@gmail.com if you suspect unauthorized access to your account.

We are not liable for any loss or damage arising from unauthorized use of your account.

3.3 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to update such information as necessary. We reserve the right to suspend or terminate accounts that contain false or misleading information.

4. Description of Service

Kinesis is a free social fitness application that provides the following features:

• Fitness Tracking: Create and log workouts, exercises, sets, and repetitions; track workout sessions and calories burned; maintain workout streaks.
• Nutrition Tracking: Log meals and food items; track daily caloric intake and macronutrients; scan product barcodes; use AI-powered food photo analysis.
• Health Integration: Sync steps, active calories, and external workout data from Apple Health (iOS) or Google Health Connect (Android) with your explicit permission.
• Social Features: Create and share posts (text, images, videos); like and comment on posts; follow other users; receive push notifications.
• Personalized Goals: Set and track calorie budgets and fitness goals based on your profile.

The App is provided free of charge with no in-app purchases, subscriptions, or advertisements.

5. User Conduct

By using Kinesis, you agree to comply with the following rules of conduct. You shall not:

5.1 Prohibited Content

• Post, upload, or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, sexually explicit, or otherwise objectionable.
• Post content that promotes violence, discrimination, racism, sexism, hatred, or bigotry against any individual or group.
• Share pornographic or sexually suggestive material.
• Post content that infringes on any third party's intellectual property rights, including copyrights, trademarks, or trade secrets.
• Share spam, scams, phishing attempts, or deceptive content.
• Post misleading health or medical advice that could cause harm to others.

5.2 Prohibited Behavior

• Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity.
• Harass, bully, stalk, intimidate, or threaten other users.
• Attempt to gain unauthorized access to other users' accounts, the App's servers, or any connected systems.
• Use automated systems, bots, scrapers, or crawlers to access, collect data from, or interact with the App.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Attempt to circumvent any content moderation, security features, or access restrictions.
• Use the App for any commercial purpose without our prior written consent.
• Upload or transmit viruses, malware, or other malicious code.
• Interfere with or disrupt the App's infrastructure, servers, or networks.
• Create multiple accounts to evade bans or restrictions.

5.3 Reporting Violations

Users may report inappropriate content or behavior through the in-app reporting feature. Reports can be filed for the following reasons: Discrimination, Violence, Pornography, Spam or Scam, and Harassment. We review reports and take appropriate action, which may include content removal, warnings, or account termination.

6. User-Generated Content

6.1 Your Content

You retain ownership of the content you post on Kinesis, including posts, images, videos, comments, and profile information ("User Content"). By posting User Content on Kinesis, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, display, reproduce, modify, and distribute your User Content solely for the purpose of operating and providing the App.

This license ends when you delete your User Content or your account, except where your content has been shared with others and they have not deleted it, or where retention is required by law.

6.2 Content Moderation

We reserve the right, but are not obligated, to:

• Review, monitor, and moderate User Content.
• Remove or disable access to any User Content that violates these Terms.
• Use automated systems (including NSFW detection models) to screen uploaded content.
• Suspend or terminate accounts of users who repeatedly violate these Terms.

6.3 Content Responsibility

You are solely responsible for your User Content. We do not endorse, support, represent, or guarantee the accuracy, truthfulness, or reliability of any User Content.

7. Health and Fitness Disclaimer

Kinesis is not a medical application. The fitness tracking, nutrition tracking, calorie calculations, AI-powered food analysis, and health data features provided by the App are for informational and educational purposes only.

• The App does not provide medical advice, diagnosis, or treatment.
• Calorie estimates, macronutrient calculations, and AI food analysis results are approximations and may not be accurate.
• Health data synced from Apple Health or Google Health Connect is displayed as-is and is not independently verified by Kinesis.
• You should consult a qualified healthcare professional before starting any new exercise program, diet, or nutrition plan, especially if you have pre-existing health conditions.
• We are not responsible for any injury, health issue, or adverse outcome resulting from your use of the App's fitness or nutrition features.

By using the fitness and nutrition features, you acknowledge and accept these limitations.

8. Intellectual Property

8.1 Our Property

The App, including its design, logos, trademarks, source code, algorithms, user interface, and all related intellectual property, is owned by Ivan Sentemon and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any part thereof without our express written permission.

8.2 Feedback

If you provide us with feedback, suggestions, or ideas regarding the App, you grant us the right to use such feedback without restriction or compensation.

9. Third-Party Services

The App integrates with or relies on the following third-party services:

• Google OAuth — for social sign-in
• Apple HealthKit — for iOS health data integration
• Google Health Connect — for Android health data integration
• Expo / Expo Application Services — for push notifications and app distribution
• Azure Blob Storage — for media file storage
• Open Food Facts — open food products database for nutritional information lookup by product name or barcode. Data is provided under the Open Database License (ODbL)

Each of these services is governed by its own terms of service and privacy policy. We are not responsible for the practices, policies, or availability of third-party services.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ivan Sentemon and any affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the App.
• Your violation of these Terms.
• Your User Content.
• Your violation of any rights of a third party.
• Your violation of any applicable law or regulation.

13. Content and Account Moderation

We reserve the right, at our sole discretion, to:

• Remove or modify any User Content that we determine violates these Terms or may be harmful, offensive, or objectionable.
• Suspend or temporarily restrict your access to the App for suspected violations.
• Permanently terminate your account for repeated or severe violations of these Terms.
• Cooperate with law enforcement when required or when we believe in good faith that such cooperation is necessary.

14. Account Termination

14.1 Termination by You

You may stop using the App at any time. You may delete your account through the in-app settings (Settings → Account → Delete Account) or by emailing kinesis.fitness.app@gmail.com.

14.2 Termination by Us

We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms.
• Abusive, fraudulent, or illegal activity.
• Extended inactivity (we will notify you before terminating inactive accounts).

14.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately.
• We will delete your personal data in accordance with our Privacy Policy.
• Provisions that by their nature should survive termination (including Sections 6.1, 8, 10, 11, 12, and 17) shall survive.

15. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

16. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will:

• Update the "Last Updated" date at the top of this document.
• Notify you through the App or via email.

Your continued use of the App after the revised Terms become effective constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the App and delete your account.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Ivan Sentemon resides, without regard to its conflict of law provisions.

17.2 Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at kinesis.fitness.app@gmail.com. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through the competent courts of the jurisdiction specified above.

17.3 Class Action Waiver

To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class, consolidated, or representative action.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ivan Sentemon regarding your use of the App and supersede all prior agreements.

20. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

21. Assignment

You may not assign or transfer these Terms without our prior written consent. We may freely assign these Terms without restriction.
